Conflicto de competencia suscitado entre el Juzgado Laboral del Circuito de Rionegro (Antioquia) y el Juzgado Primero Promiscuo de Familia del Circuito de la misma ciudad.

El conflicto se originó en torno a las diferentes interpretaciones que hicieron los despachos judiciales involucrados del factor funcional.

Ellos presentaron una serie de argumentos relacionados con la interpretación del artículo 32 del Decreto 2591 de 1991, referentes al entendimiento de la expresión “superior jerárquico correspondiente”.

Considera la Corte que quien debe resolver la impugnación formulada contra el fallo proferido por el Juzgado Promiscuo Municipal de San Vicente Ferrer (Antioquia) es el Juzgado Primero Promiscuo de Familia del Circuito de Rionegro, a quien dispone enviar el expediente para que de manera inmediata adopte la decisión de fondo que corresponde.
